Recently introduced Safe Harbour provisions provide protection to directors from personal liability when navigating companies through financial distress and possible insolvency in certain circumstances. Under these new laws, directors may no longer be liable for insolvent trading if, after suspecting insolvency, they begin to develop “one or more courses of action” that are “reasonably likely to lead to a better outcome for the company” compared to the appointment of external administrators.
Our presenter will explore the Safe Harbour laws in detail and provide practical insights into some of the key considerations and challenges for directors in adopting Safe Harbour protection.
