The session would examine getting capital to clients from companies or Trusts and will consider the following issues:

  • Share buy backs
  • Capital distributions from Discretionary/Unit Trusts
  • Tax implications and CGT events arising.

On successful completion of this topic, participants will be able to:

  • Compare the CGT/income tax outcomes for share buy-backs under different factual scenarios 
  • Compare the CGT/income tax outcomes for capital distributions and unit redemptions for a Unit Trust.
  • Gain an understanding of how capital distributions from a discretionary trust are taxed and made in practice.

Stephen is a partner at WMS Chartered Accountants and has more than 20 years’ experience in providing specialist tax advice. He has concentrated on tax consulting and has provided tax advice to high-net-worth clients since 1994. Stephen also consults to other accounting firms on technical and/or complex tax matters. His particular focus is capital gains tax, employee share schemes, tax consolidation and international tax matters. He has extensive experience in managing tax disputes with the Australian Taxation Office.
 

Bruce Thomas, Senior Tax and Superannuation Trainer, CA ANZ  

Bruce Thomas Senior Tax and Superannuation Trainer Bruce has written and presented training on a wide range of topics, including the tax aspects of real estate transactions, fringe benefits tax (FBT) and salary packaging. Bruce was previously a tax manager with William Buck Chartered Accountants where he advised clients on the application of the goods and services tax, FBT and other government charges. He worked for the Australian Taxation Office for 17 years, including as a senior officer dealing with technical issues involving the GST.
