Review of an Investigation into Underpayments of Payroll Obligations and Remediation
This session will provide an overview of the impacts associated with the discovery of an underpayment of wages, from a legal, quantification and remediation perspective.

With an increasing focus by the Fair Work Ombudsman, it is imperative for organisations to ensure they are compliant in respect to payroll obligations, but many organisations are still prone to an underpayment of wages, whether that be as a result of wage theft, not being cognisant of updated Award provisions, changes in minimum requirements, or a misinterpretation of industrial instruments and employee contracts.

Our presenters Sarah Thorburn CA, Account Director in the Perth Forensic practice at Deloitte, and Briony Pole, Senior Associate at Minter Ellison, will also discuss a recent investigation of payroll underpayments which involved identification of affected personnel, review of relevant awards, quantification of underpayments, and remediation.

Sarah Thorburn CA is an Account Director in the Perth Forensic practice of Deloitte. Sarah is a qualified Chartered Accountant who specialises in complex forensic accounting, expert consulting for litigation support and the preparation of independent expert reports in litigation matters. Sarah also has experience in conducting investigations and contract compliance examinations and is the Deloitte Perth Forensic lead director for the provision of Deloitte's PaySmart analytics services, which provides a multi-dimensional approach to payroll and workplace relations governance, strategy and optimisation.

Briony Pole is a Senior Associate at Minter Ellison’s Human Resources & Industrial Relations practice.  She provides tailored, commercial legal advice across all aspects of workplace relations and safety and works with clients across a range of industries including utilities, rail, mining, health care, storage and handling, media and local government.  Briony works closely with clients to achieve commercial and strategic outcomes and provides advice aligned to business needs and objectives.
