Special Tax & Superannuation Topics 2023-24 - Part 1: Essential SMSF estate planning - Pre death

There are a number of essential estate planning issues that need to be considered and effectively implemented by almost all SMSF members, well before their death. This session will highlight the relevant issues at both the individual member level, and also the fund and trustee level.

We will cover:
• How death benefits can be paid and to whom they can be paid to
• Tax issues around separate members superannuation interests inside a SMSF
• SMSF tax outcomes, strategies and key trustee decisions affecting the payment of death benefits
• Planning for appropriate SMSF shareholding and directorships
On successful completion of this topic, participants will be able to:
  • Understand the regulatory and fund specific requirements for death benefit payment documentation.
  • Understand and apply the strict SIS and Tax rules applicable to the payment of Superannuation death benefits.
  • Identify appropriate client and fund strategies to manage the tax payable on the death of a SMSF member
  • Understand the required planning and paperwork necessary for the ongoing management and operation of the SMSF post the death of a fund member.
